Terms of use
The essentials
Ash is a support tool, not a medical device and not a treatment. Downloading it is free; Ash Premium is an in-app purchase, billed by Apple and cancellable from the App Store at any time.
1. Scope
These terms govern the use of the Ash mobile app published by Refacto Studio ("we"). Installing or using Ash means accepting them. If you do not accept them, do not use the app.
2. What Ash does
Ash helps you track your tobacco use, get through cravings and see your progress. It offers a counter, a craving and mood journal, statistics, a three-minute "Craving SOS" protocol, savings tracking and an indicative recovery timeline.
3. What Ash does not do — health notice
Ash is not a medical device, makes no diagnosis, prescribes no treatment and is no substitute for professional medical advice. The recovery milestones it shows are averages drawn from public-health literature: they are indicative and vary from person to person.
If you are on medication, pregnant, or experiencing unusual symptoms while quitting, talk to a doctor or a smoking-cessation specialist. In France, Tabac info service is free on 39 89. In a life-threatening emergency, call your local emergency number — 112 across the European Union.
4. Your account
Ash creates an anonymous account automatically, with no sign-up. You are responsible for the device it is installed on. Because the account is tied to no email, it cannot be recovered if you lose your device, uninstall the app or use "Sign out".
5. Ash Premium
5.1 What the subscription unlocks
Nearly all of Ash is free. Ash Premium unlocks the photo journal beyond the first three photos, plus two extra mini-games during Craving SOS.
5.2 Plans and prices
Ash Premium is offered as a weekly or yearly subscription, or as a one-off lifetime purchase. Prices are shown by the App Store in your currency before any purchase and may vary by country. The yearly plan may include a free trial whose length is stated on the purchase screen.
5.3 Billing and renewal
Payment is charged by Apple to your App Store account on confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Renewal is charged within the 24 hours before the period ends.
5.4 Cancellation
You can cancel at any time from iOS Settings → your name → Subscriptions → Ash. Cancellation takes effect at the end of the period already paid for: access remains open until then. Cancelling during a trial ends it under Apple’s rules. We have no way of cancelling a subscription on your behalf.
5.5 Refunds
Purchases are processed by Apple, so refunds follow its policy and are requested at reportaproblem.apple.com. We cannot refund an App Store purchase directly.
6. Acceptable use
You agree not to circumvent the app’s technical limitations, not to decompile it beyond what the law allows, not to scrape its content and not to use it to harm others.
7. Intellectual property
The app, its code, design, copy and illustrations belong to Refacto Studio and are protected by copyright. We grant you a personal, non-exclusive, non-transferable licence to use Ash on devices you own. The data you enter remains yours.
8. Availability and changes
We work to keep Ash available without guaranteeing uninterrupted service. We may change, suspend or withdraw a feature. Should a paid feature disappear for good, subscribers will be told in the app.
9. Liability
Ash is provided "as is". To the extent permitted by law, we are not liable for the decisions you make about your health, for a relapse, or for data lost by uninstalling the app or using "Sign out". Nothing here limits the rights consumers hold under French law.

How we handle your data is described in our privacy policy, which forms part of these terms.
11. Apple’s terms
Because Ash is distributed on the App Store, Apple’s standard end-user licence agreement also applies: apple.com/legal/internet-services/itunes/dev/stdeula. Where the two conflict on distribution or payment, Apple’s terms prevail. Apple is not a party to these terms and is not responsible for the app.
12. Changes to these terms
We may amend these terms. The update date sits at the top of this page; substantial changes are flagged in the app. Continuing to use Ash after they take effect means accepting them.
13. Governing law
These terms are governed by French law. Failing an amicable settlement, the French courts have jurisdiction. European consumers may also use the European Commission’s online dispute resolution platform.
